Which Agreement Applies Based on Your Move Date

Understanding whether the Withdrawal Agreement or the Trade and Cooperation Agreement governs your UK-Spain rights based on when you moved to Spain.

The date you moved to Spain determines which agreement protects your rights: the Withdrawal Agreement (for those who moved before Brexit) or the Trade and Cooperation Agreement (for those who moved after). This guide explains the critical cutoff date and what each agreement means for you.

The Critical Cutoff Date: December 31, 2020

If you moved to Spain before January 1, 2021, you're covered by the Withdrawal Agreement.

If you moved to Spain on or after January 1, 2021, you're covered by the Trade and Cooperation Agreement (TCA).

Important: "Moved to Spain" means you established legal residency in Spain before the cutoff date. Simply owning property or visiting does not count—you must have registered as a resident (obtained a green certificate or TIE) before January 1, 2021.

Before December 31, 2020: Withdrawal Agreement

The Withdrawal Agreement (WA) protects the rights of UK nationals who were already living in Spain before Brexit. It provides permanent protection similar to pre-Brexit EU coordination rules.

Who qualifies:

  • UK nationals who moved to Spain and registered as residents before January 1, 2021
  • You must have been lawfully residing in Spain on December 31, 2020 (with a green certificate or TIE)
  • Protection is permanent as long as you continue to live in Spain or maintain close ties (even if you move elsewhere temporarily)

1. Residency and work rights:
  • Permanent right to live, work, and study in Spain
  • Right to bring family members (spouse, children, dependent parents)
  • After 5 years of residence, you can apply for permanent residence status
2. Healthcare:
  • Access to Spanish healthcare system (if working or a pensioner)
  • UK state pensioners can use an S1 form to access Spanish healthcare (UK pays Spain)
  • EHIC/GHIC cards remain valid for temporary visits to the UK and other EU countries
3. Social security coordination:
  • UK and Spanish social security contributions are aggregated for pension purposes
  • Posted workers can continue paying UK social security for up to 24 months (A1 certificate)
  • Unemployment benefits can be exported for up to 3 months while job hunting in Spain
4. Pensions:
  • UK state pension paid in full to Spain, uprated annually
  • Pension aggregation: UK + Spanish contributions count towards eligibility
5. Professional qualifications:
  • UK qualifications obtained before 2021 are recognized in Spain
  • Ongoing recognition of professional qualifications for regulated professions (doctors, lawyers, engineers)

Example: Pre-2021 Mover

Sarah, a UK national, moved to Málaga in October 2019. She registered as a resident and obtained her green certificate in November 2019. She's permanently protected by the Withdrawal Agreement and enjoys full healthcare access, pension aggregation, and the right to work without restriction. Even if she temporarily moves back to the UK for a year, she can return to Spain under the WA protection.

From January 1, 2021: Trade and Cooperation Agreement (TCA)

The Trade and Cooperation Agreement (TCA) is the new agreement governing UK-EU relations post-Brexit. It provides fewer rights than the Withdrawal Agreement, but still covers key areas like social security, posted workers, and pensions.

Who it applies to:

  • UK nationals who moved to Spain on or after January 1, 2021
  • UK nationals who did not register as residents before January 1, 2021 (even if they owned property or visited frequently)

Key rights under the TCA:

1. Residency and work rights:
  • NO automatic right to live or work in Spain
  • You must apply for a visa or residence permit (TIE) like any other third-country national
  • Common options: non-lucrative visa, digital nomad visa, golden visa, work permit
2. Healthcare:
  • NO EHIC/GHIC for tourists (you need private travel insurance when visiting Spain)
  • If you work in Spain, you're covered by Spanish healthcare as normal
  • UK state pensioners living in Spain can still use an S1 form to access Spanish healthcare
3. Social security coordination:
  • Posted workers can continue paying UK social security for up to 24 months (A1 certificate)
